Requirements for Protecting a Patent Overseas
There are several requirements that must be met when protecting a patent in the international competitive structure. One concern that companies must meet is making sure that their patents are safe in areas of the world where they are ignored or simply not recognized in the eyes of the nation’s laws. There has been speculation that some nations have ignored international legal requirements for protecting patents outside their jurisdiction for legitimate reasons. One suggestion is that developing companies often need to ignore patents to promote industrial growth. But at what expense for foreign competitors? Are Patent-Free Zones a Threat to Competition?
On the other hand, patent-Free Zones may not be quite as dangerous as we may think. If a product developed in such a country doesn’t meet the legal requirements of any patent it will probably not be able to export it back into a country where the patent was applied for. This should be encouraging for most entrepreneurs trying to protect their business’s latest invention. It becomes unnecessary to file a patent in every single country in the world out of paranoia. They can focus on just obtaining patents in those countries where they are most likely to try to gain market share. Should a Patent be Secured in a Developing Economy?
However, just because a patent does not need to be filed in a developing company to protect the idea, doesn’t mean that it shouldn’t be. Ignoring emerging markets can be a bad move if only for the reason that they will be passing up huge potential market share. Developing nations may already be a bigger market than you might think and they could be a huge market in a few years. Filing for a patent may not be a requirement there, but it could be a very foolish idea for a shrewd business. It is sound business to make sure that any market is researched for potential opportunities. If a country looks like it is a viable opportunity, it may be worth the cost of applying for a patent. Like any business decision, a cost-benefit analysis should be the best approach to take before making such an important decision.
